Personal Information Collection:
You will need to provide Personal Information to register with and subscribe to the Fit Mix Service to search and book classes. To register with the Fit Mix Service, you must submit your first and last name, email address, phone number, personal photo, password, billing address and credit card information.

In the future, you may also be able to register by using your Facebook login credentials. When you login with your Facebook credentials, we collect the Personal Information you have made publicly available in Facebook, such as your name and profile picture and use that information to register with the Fit Mix Service. We may also obtain other information with your permission, such as your gender, date of birth, and Facebook friends. The information the Fit Mix Service obtains may depend on your Facebook privacy settings.

The Fit Mix Service may also collect Personal Information from you in other ways. For example, you may be asked to provide your city, state, zip code, or neighborhood to find studios and classes near you. The Fit Mix Service may also collect Personal Information through contacts with our customer-support team and if you include it when you submit reviews or comments while using the Fit Mix Service.

The Fit Mix Service may collect credit card and billing information to process payments. This information is secured according to PCI Data Security Standards.

The Fit Mix Service may collect and store your location information if you enable your computer or mobile device to send it to us. Changing the settings on your computer or mobile device may prevent this data collection.

The foregoing Personal Information is collected to in order to provide and operate the Fit Mix Service and render our services to you in accordance with our Membership Agreement, in particular, (a) to facilitate and coordinate registration of fitness classes; (b) to provide you, to the extent possible and reasonable, with a smoothly and accurately functioning Fit Mix Service by monitoring and maintaining its performance (in particular, detecting and resolving issues and errors); and/or (c) to enable and process communication with our support service in case of queries, by e-mail, social media or phone.

This processing is necessary for the performance of our agreement with you.

Cookies, Automatic Data Collection, and Related Technologies:
In addition, the Fit Mix Service collects and stores information that is generated automatically as you use it. This information includes anonymous usage statistics. To collect this information, the Fit Mix Service may use log files, web beacons, cookies, and other similar technologies.

For example, the Fit Mix Service uses cookies to store users' preferences and website or app activity session information. "Cookies" are bits of information that are stored by your browser or app on your computer or mobile device. This technology allows for the storage of user preferences, user ID, and password. You can turn off the “cookie” function in most standard Internet browsers; however, the majority of the features of the Fit Mix Service may not function properly without them.

The Fit Mix Service automatically collects other system information, such as your web request, Internet Protocol ("IP") address, browser type, browser language, domain names, referring and exit pages and URLs, platform type, number of clicks, landing pages, pages viewed and the order of these page views, the amount of time spent on particular pages, the date and time of your request, and the unique identity of your browser. This information is used to analyze trends, administer the Fit Mix Service, improve the design of the Fit Mix Service, track user movement, and otherwise enhance the Fit Mix Service.

Your Consent:
By using the Fit Mix Service, you consent to placement of cookies on your browser by Fit Mix and any third party service providers, and are authorizing Fit Mix to gather, parse, and retain data related to the provision of the Fit Mix Service.

Withdraw Your Consent at Any Time :
You have the right to delete and block Fit Mix’s cookies. You may do so by exercising control of most cookies through the browser settings. However, if you use your browser settings to block all cookies, you may not be able to access all or parts of the Fit Mix Service. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies as soon as you visit the Fit Mix Service.

The browser settings for changing your cookies settings are usually found in the 'options' or 'preferences' menu of your internet browser. Internal and Service-related Usage:
Fit Mix uses Personal Information for internal and service-related purposes only and may provide it to third parties to allow Fit Mix to offer the Fit Mix Service.

Advertising:
Fit Mix does not rent, sell, or share Personal Information about you with other people or nonaffiliated companies for advertising purposes. Fit Mix may allow access to other data collected by the Fit Mix Service to enable the delivery of advertising and offers that will be of greatest utility, relevance, value, and interest to you.

Improve Service:
Fit Mix may retain any data you provide to provide customer support, track the types of questions we receive, analyze trends, track user movement, personalize your experience, and otherwise enhance the Fit Mix Service.

Communications:
We may send you a welcome email to verify your account and other emails for operational purposes, such as billing, account management, class confirmations and cancelations or system maintenance, as well as for marketing purposes such as promotional offers from Fit Mix or our partners, as well as class, studio, event and fitness and nutrition related content.

Studios:
Fit Mix may provide some Personal Information, such as your name and email address, to a studio when you book a class there, just as if you booked a class directly with the studio. Studios are separate businesses from Fit Mix, and Fit Mix is not responsible for the privacy practices of those businesses.

Vendors and Suppliers:
Fit Mix may share any information it receives with vendors and suppliers retained in connection with the provision of the Fit Mix Service. For example, we may share your credit card and billing information to third-party service providers that perform credit card transactions.

Social Networking and Other Websites:
When you use the Fit Mix Service, you may share Personal Information with social networking websites, such as Facebook, Google+, Pinterest, Instagram, Twitter, and Foursquare. You may also share information with other web applications, such as Outlook, Google calendar, and Yahoo! Calendar. We do not share information with them unless you direct the Fit Mix Service to share it. Their use of the information will be governed by their privacy policies and you may be able to modify your privacy settings on their websites.

Sweepstakes:
From time to time, Fit Mix participates in email sweepstakes and you must affirmatively opt in with your consent to enter into such email sweepstakes and agree to share your information, including any Personal Information, with such third party affiliate marketers under their own terms of service/use and privacy policy agreements. We are not responsible for any information collected by such third parties who conduct such sweepstakes.

As Required By Law and Similar Disclosures. Fit Mix may access, preserve, and disclose your Personal Information, other account information, and content if it believes doing so is required by law or if those actions are reasonably necessary to:

1. comply with legal process, such as a court order or subpoena;
2. enforce this Privacy Policy or Fit Mix's Membership agreement;
3. respond to claims that any content violates the rights of third parties;
4. respond to your requests for customer service;
5. respond to law enforcement;
6. investigate and prevent unauthorized transactions or other illegal activities; OR
7. protect the rights, property, or personal safety of Fit Mix, our users, or the public.

When Fit Mix handles information that you disclose through the Fit Mix Service, regardless of where this occurs, Fit Mix takes steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, Fit Mix cannot ensure or warrant the security of any information you transmit through the Fit Mix Service, and you do so at your own risk. Fit Mix does not accept liability for unintentional disclosure.

Fit Mix does not knowingly collect, maintain, or use any Personal Information from children under 13 years of age. No part of the Fit Mix Service is directed to persons under the age of 13. In fact, you must be at least 13 years of age to set up an account with the Fit Mix Service. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS the Fit Mix Service AT ANY TIME OR IN ANY MANNER.

If Fit Mix becomes aware that it has collected any Personal Information from children under 13, it will promptly delete such information from our databases. If you are a parent or guardian and discover that your child under the age of 13 has obtained a Fit Mix Service account, then you may alert Fit Mix at contact@FitMixOnline.com and request that Fit Mix delete that child's Personal Information from our systems.

In the event Fit Mix enables and allows for any persons to register with the Fit Mix Service in a jurisdiction under the European Union (EU), Fit Mix shall not knowingly collect, maintain, or use any Personal Information from children under 16 years of age. Fit Mix shall ensure that the necessary protocols and procedures are in place to secure a parent’s consent and any other information to confirm that the registered user is at least 16 years of age under the European Union General Data Protection.

By choosing to visit the Fit Mix Service or otherwise provide information to Fit Mix, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of New Mexico.

If you are accessing the Fit Mix Service from any physical location with regulations or laws governing personal data collection, use, or disclosure that differ from United States regulations or laws, please note that through your continued use of the Fit Mix Service, you are transferring Personal Information to the United States of America or other jurisdiction where such information may be processed and you consent to that transfer, provided that Fit Mix shall comply with the European Union Data Protection in the event Fit Mix allows for users in the EU to register with the Fit Mix Service.

You also consent to the adjudication of any disputes arising in connection with Fit Mix or the Fit Mix Service in accordance with the Membership Agreement.

Fit Mix reserves the right to send you certain communications relating to Fit Mix, such as service announcements and administrative messages that are considered part of your Fit Mix account.
